Terms and Conditions of Sale

These Terms and Conditions of Sale ("Terms") apply to all purchases made from SIXPM Wear LLC, a company registered in the United States with its principal place of business at 9 Hollow Ridge Drive, Memphis, Tennessee, 38126, United States, through its website located at sixpmwear.com ("Website"). By placing an order through our Website, you agree to be bound by these Terms.

1. Definitions

  • "Company," "we," "us," or "our" refers to SIXPM Wear LLC.
  • "Customer," "you," or "your" refers to the person or entity purchasing goods from the Company.
  • "Goods" refers to the products offered for sale on our Website.
  • "Order" refers to the request by the Customer to purchase Goods from the Company.

2. General Conditions

All Orders placed by the Customer are subject to acceptance by the Company. The Company reserves the right to refuse or cancel any Order for any reason. If an Order is refused or canceled, the Company will make reasonable efforts to inform the Customer using the contact details provided at the time the Order was placed.

3. Prices and Payment

All prices for Goods are listed on our Website and are subject to change without notice. Prices are stated in United States Dollars (USD) and do not include applicable taxes, shipping, and handling charges, which will be added to the total amount due during the checkout process.

Payment must be made at the time of placing an Order using the payment methods available on our Website. The Company is not responsible for any errors that occur during the payment process. The Order will not be processed until payment has been received in full.

4. Delivery

The Company will deliver Goods to addresses within the United States. Announced delivery times are estimated to be between 5 to 9 business days from the date the Order is processed. The Company is not liable for any delays in delivery that are beyond its control.

5. Returns and Refunds

Customers may return Goods within 14 days from the date of delivery for a refund or exchange subject to the following conditions:

  • Goods must be returned in their original condition, unused, and in the original packaging.
  • Proof of purchase is required for all returns.
  • Return shipping costs are the responsibility of the Customer unless the Goods are defective or were shipped incorrectly by the Company.

Refunds will be processed within 14 business days of receipt of the returned Goods. The original shipping charges are non-refundable.

6. Limitation of Liability

The Company's liability is limited to the purchase price of the Goods. The Company is not liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or use, in connection with or arising out of the use or inability to use the Goods, whether based on contract, tort, strict liability, or otherwise, even if the Company has been advised of the possibility of such damages.

7. Force Majeure

The Company shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the breach thereof shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The place of arbitration shall be Memphis, Tennessee, and the arbitration shall be conducted in English.

9. User Obligations

By using the Website, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract. You agree to provide accurate, current, and complete information at all times, and to promptly update such information as necessary.

11. Amendments

12. Entire Agreement

These Terms, together with any other policies or documents referenced herein, constitute the entire agreement between the Customer and the Company regarding the purchase of Goods and supersede all prior and contemporaneous agreements, understandings, negotiations, and discussions, whether oral or written.

By placing an Order with SIXPM Wear LLC, you acknowledge that you have read, understood, and agree to be bound by these Terms.
